Instructor Terms and Conditions for Parents and Guardians 

  1. Agreement

The Instructor shall supply the Parent/Guardian and Student(s) with all materials necessary to deliver the Kumon method in exchange for the fees as set out in Clauses 2 and 3. This may include, but not be limited to, worksheets and answer books. 

  1. Registration

  1. The registration fee of £50 will be payable, along with a non-refundable deposit of £80 (which represents the first months’ subject fee), upon registration of the student(s);

  2. The Parent/Guardian shall be provided with a copy of the Kumon Europe and Africa Ltd (Kumon UK) Privacy Notice. The Privacy Notice explains how the Instructor shares the Student information with Kumon Institute of Education Co., Ltd (KIE), Kumon UK’s Parent Company (and with Kumon group entities, as required) in accordance with the relevant data protection legislation. The sharing of data allows Kumon UK to monitor Student development and ensure the Student receives the best instruction possible to progress.

  1. Monthly Subject Fees

  1. The Parent/Guardian shall pay a monthly fee of £80 per subject, per student; payable in advance each calendar month;

  2. The Instructor reserves the right to increase its monthly subject fee and/or registration fees, provided that the Instructor gives the Parent/Guardian 3 calendar months’ written notice of the change. 

  1. Study

  1. In the Centre:

  1. The Student shall arrive at the Centre at the time allocated to them;

  2. The Student shall complete their work in a manner which does not affect the work of other students;

  3. The Parent/Guardian shall not enter the Study Centre during class hours unless authorised to by a Kumon Instructor or assistant;

  4. The Parent/Guardian shall wait for the Student to complete their work in the designated waiting area; or the Parent/Guardian shall arrange with the Instructor how the Student is to arrive and leave the Centre and with whom (if appropriate). 

  1. At home:

  1. The Student shall continue to complete the worksheets daily as appropriately allocated to them by the Instructor;

  2. The Parent/Guardian shall mark all work completed at home and ensure the Student corrects any work as necessary.  The Parent/Guardian shall check all corrections as necessary.  The Parent/Guardian will also listen to the Student read from the English worksheets as instructed to do so by the Instructor. 

  1. Student Absence and/or Incomplete work

  1. If the Student fails to attend class regularly without notice or returns incomplete work, the Instructor reserves the right to request the parent to withdraw the Student(s) from the programme. 

  2. If the Student fails to attend class regularly without notice or returns incomplete work, the Instructor reserves the right to re-enrol the student at any time in the future. This would make any registration fee and deposit payable where appropriate;

    1. If the Student is absent for any reason (due to illness, injury etc.), the Parent/Guardian shall inform the Instructor as soon as practicably possible. 

  1. Holidays

  1. Where possible, the Parent/Guardian shall give the Instructor a minimum of 2 weeks’ notice of any holiday leave so the Instructor can prepare suitable work for the Student to complete during the holiday. The Instructor shall provide Holiday Forms to all Parents/Guardians to be completed and returned to the Instructor prior to the commencement of the holiday leave. 

  1. Withdrawal from the study programme

  1. If the Parent/Guardian wishes for their Student(s) to withdraw from the study programme:

  1. The Parent/Guardian will give the Instructor one calendar months’ written notice;

  2. The Parent/Guardian will pay all fees up to and including the last day of the Students’ study programme (as applicable);

  3. The Parent/Guardian must return all Kumon materials to the Instructor on or before the last day of the Students’ study programme (this may include, but not be limited to unused worksheets and answer books);

  4. The Parent will attend an exit interview with the Instructor.

  1. The Instructor may withdraw a Student from the study programme, on the occurrence of any of the following:

  1. Non-payment of fees; or

  2. Persistent and continuous disruptive behaviour of the Student or Parent/Guardian during class time and/or within the Study Centre; or 

  3. Incomplete work by the Student; or 

  4. Incomplete marking by the Parent/Guardian; and/or 

  5. Upon the failure of the Student to attend the Centre on a regular basis.

  1. In cases when the Student is studying more than one subject, the Instructor reserves the right to withdraw a Student in one subject if they feel the Student is not making adequate progress in one subject more than another. 

  2. The Instructor shall use reasonable endeavours to assist the Parent/Guardian to comply with the terms and conditions contained herein; however, the Instructor is not obliged to retain a Student if any of the conditions set out at clause 5(b) prevail. 

  1. Governing Law and Jurisdiction

    a) This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of [England and Wales]/[Ireland] (delete as applicable). 

    b) Each party irrevocably agrees that the courts of [England and Wales]/[Ireland] (delete as applicable) shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
